Upwork Escrow Explained: How to Hire a Developer Without Getting Scammed

How Upwork escrow works, when to use fixed-price vs hourly, milestone structure, and how clients and developers both stay protected on freelance contracts.

Hiring on Upwork feels risky until you understand escrow. Escrow means your money is held by Upwork until you approve the work. The developer does not get paid until you click approve (or auto-release after 14 days). That single mechanism is why millions of software projects run through the platform every year.

How Upwork escrow works (step by step)

  1. You post a job or send an offer with clear scope and budget.
  2. Developer accepts. For fixed-price, you fund the contract (money goes into escrow).
  3. Developer submits work per milestone or at project end.
  4. You review. Approve to release payment, or request revisions.
  5. Funds release to the developer. Upwork takes a fee (client side is typically 3–5% on top).

Fixed-price vs hourly on Upwork

Fixed-price (best for defined scope)

Use fixed-price when you have a clear spec: landing page, MVP with defined features, API integration, bug fix batch. Split into 2–4 milestones. Example: Milestone 1 — design + auth. Milestone 2 — core features. Milestone 3 — polish + deploy.

Hourly (best for ongoing or unclear scope)

Use hourly when scope will change — maintenance, R&D, ongoing feature work. Enable Work Diary for transparency. Cap weekly hours so costs stay predictable.

Milestone structure that actually works

  • Never fund 100% upfront on a single milestone for a large project.
  • First milestone should be small — setup, wireframes, or auth — to test communication.
  • Each milestone needs acceptance criteria: "User can sign up, see dashboard, create item."
  • Keep 10–15% for final delivery + deployment + handoff documentation.

Direct contract after Upwork — when it makes sense

Many clients start on Upwork for escrow protection, then move to direct contract for repeat work (lower fees, faster payments). That is normal. Just make sure the first project completed successfully on-platform before going off. Always use milestones or escrow equivalents off-platform too.
